These Terms of Service ("Terms") govern your access to and use of the delivery platform, mobile applications, and websites provided by AfrikieGo Logistics Limited ("AfrikieGo", "we", "us"). By creating an account or using our Services, you agree to these Terms. If you do not agree, do not use the Services.
1Acceptance and eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services you confirm that the information you provide is accurate and that you will keep it up to date.
2Definitions
- "Customer" — a user who requests a delivery.
- "Merchant" — a business that uses AfrikieGo to fulfil deliveries.
- "Rider" — a delivery partner who accepts and completes deliveries.
- "Order" — a delivery request placed through the Services.
3Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at compliance@afrikiego.com if you suspect unauthorised use. We may suspend or terminate accounts that violate these Terms.
4The Services
AfrikieGo operates a last-mile logistics platform that connects Customers and Merchants with Riders to arrange the pickup and delivery of goods within our service areas. We provide the technology and coordination; delivery is carried out by Riders.
5Orders and delivery
- When you place an Order, you authorise AfrikieGo to arrange its delivery on the terms shown at the time of the Order.
- You must provide accurate pickup and drop-off details and ensure someone is available to hand over or receive the goods.
- Delivery times are estimates and may be affected by traffic, weather, and other conditions.
- You are responsible for ensuring the goods you send are lawful and properly packaged.
6Prohibited items and conduct
You may not use the Services to send or transport anything illegal, hazardous, stolen, or otherwise prohibited by law, nor to harass, defraud, or harm others, interfere with the Services, or attempt to gain unauthorised access to our systems.
7Payments, fees and refunds
- Charges for a delivery are shown before you confirm an Order. Payment may be made by cash on delivery or by the digital methods we support (for example, card payments processed by our payment provider).
- You agree to pay all charges and applicable taxes for Orders placed through your account.
- Refunds and adjustments, where applicable, are handled in accordance with our support process; contact compliance@afrikiego.com.
8Rider terms
Riders must hold any licences and permits required by law, operate safely and lawfully, and complete Orders they accept with reasonable care. Additional rider-specific terms may apply and form part of these Terms for Riders.
9Intellectual property
The Services, including our software, applications, designs, and the AfrikieGo name and logo, are owned by AfrikieGo Logistics Limited and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for their intended purpose. You may not copy, modify, reverse-engineer, or create derivative works from the Services.
10Third-party services
The Services rely on third-party providers (such as payment, mapping, and cloud services). Your use of those features may be subject to the third party's own terms, and we are not responsible for third-party services.
11Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
12Limitation of liability
To the fullest extent permitted by law, AfrikieGo Logistics Limited will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited under Rwandan law.
13Indemnification
You agree to indemnify and hold harmless AfrikieGo Logistics Limited and its personnel from claims and expenses arising out of your misuse of the Services or breach of these Terms.
14Suspension and termination
We may suspend or terminate your access to the Services if you breach these Terms or where necessary to protect the Services or other users. You may stop using the Services at any time.
15Governing law and disputes
These Terms are governed by the laws of the Republic of Rwanda. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts of Rwanda, without prejudice to any mandatory consumer-protection rights.
16Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated effective date; your continued use of the Services after changes take effect constitutes acceptance.
